Abstract: Opportunities and Challenges – The Current Situation of Copyright Protection for Document Supply in China

Purpose

The purpose of this paper is to introduce current Chinese Copyright Law and its effect on document supply services in China. Summarizing the measures libraries have taken to protect copyright in International Loan, presenting the problems based on professional experience of the National Library of China (NLC). Recommending solutions about how to meet users’ growing needs for various types of information under the protection of copyright in the New Media Age.

Design

  • In 2017 and 2018, NLC was accused twice of violating copyright in document supply services. The case involved paper copy, scanning and electronic document delivery. From analysis of these two cases, introducing the related provisions of current Chinese Copyright Law (Copyright Law of the People’s Republic of China) and the Regulation on the Protection of the Right to Network Dissemination of Information, which can be used to document supply services in China.
  • Summarizing the measures libraries have taken to protect copyright in International Loan in China, for example, real-name registration in ILL system; providing no more than 1/3 of the full text; application of technical protection measures; signing one-to-one copyright use agreements; cooperation with copyright management organizations, etc.
  • Presenting problems based on professional experience of NLC in the New Media Age, such as the potential risks of copyright infringement in document supply through Wechat(social networking), APP and WAP; how to expand access to full-text in digital delivery and so on.
  • Recommending solutions about how to meet users’ growing needs for various types of information under the protection of copyright especially in the New Media Age, such as the copyright clearing methods for document supply services through Wechat, APP , WAP and automatic digital document delivery.

Findings

With the application of Wechat, APP and WAP, the potential risks of copyright infringement in document supply become more and more serious, we must take proper steps to protect copyright especially in the New Media Age in China.

Value

This is the first article in English to describe current situation of copyright protection for document supply in China. It also presents the problems based on professional experience of NLC and recommends the solutions in the New Media Age today.
